Obesity can in some cases be considered a disability!

How does this impact your business?

In the recent case of Kaltoft v the Municipality of Billund, the claimant, a Danish childminder, claimed he had been sacked for being ‘too fat’ and that this amounted to unlawful discrimination.

The decision reached, was that although there is no general principal in EU law which prohibits discrimination on the grounds of obesity, there are conditions under which obesity can amount to a disability. Continue reading…
